Webafrica Referral Partnership

Service Provider Separation

Webafrica's Responsibility: Fibre internet connectivity, installation, network performance, speeds, uptime, technical support for connectivity issues, billing for fibre services.
Mtronika's Responsibility: Custom AI/web app design, development, maintenance, app functionality, app support, trial app delivery, post-trial app services.

Liability Separation & Disclaimers

Mtronika is NOT liable for:

Fibre connectivity issues, network outages, or speed variations
Webafrica installation delays or technical service delivery
Third-party network infrastructure failures or performance
Fibre service availability at your specific address

1. Eligibility Criteria

Trial app offer linked to new Webafrica fibre service signups through Mtronika referral only
One trial app per qualifying fibre signup (additional apps available at standard pricing)
Valid company registration required for business apps (Consumer apps: personal details sufficient)
South African residents only (RICA compliance for fibre activation)

2. Trial Period Definition

Duration: Exactly 30 calendar days from app delivery/activation date
Activation Date: Confirmed via email when app is delivered to client (ECTA Section 13 compliance)
Trial End Notification: Reminder email sent 7 days before trial expires

3. Client Decision Point (CPA Consumer Rights)

YOU ARE IN CONTROL: At day 23 of your trial, we'll email you asking:

Continue: "Yes, I want to keep my app" → Standard pricing begins after day 30
Cancel: "No thanks, cancel my trial" → App deactivated, no charges, no obligations
No Response: If we don't hear from you, trial ends automatically with NO billing

4. Post-Trial Billing & Pricing

Standard pricing applies only if client confirms continuation before trial end
Pricing based on app complexity and package selected (Managed vs Self-Managed hosting)
Payment via Paystack (month-to-month or annual billing) or debit order (email request required)
First invoice sent only after trial ends and client confirms continuation

5. Trial Scope & Service Inclusions

Custom app design & development
Brand integration (logo, colors)
Basic functionality implementation
30-day managed hosting
Technical support (email & WhatsApp)
Testing & bug fixes during trial

NOT INCLUDED IN TRIAL

Advanced AI integrations (ChatGPT, etc.)
Complex database architectures
Third-party API integrations
App store deployment (iOS/Android)
Marketing or SEO services
Post-trial hosting (requires paid plan)

6. Intellectual Property During Trial

During Trial: App code and design remain Mtronika property (you have usage rights only)
After Continuation & Full Payment: Full source code ownership transfers to client
If Trial Cancelled: Client loses access to app; Mtronika retains all intellectual property
Client Content: Your logos, branding, and content remain your property always

7. No-Obligation Cancellation Rights

Consumer Protection Act Compliance:

Cancel anytime during the 30-day trial with ZERO penalties
No early termination fees or hidden charges
No future obligations if you decide not to continue
Email support@mtronika.co.za with subject "Cancel Trial App" (processed within 24 hours)
7-day cooling-off period applies even after trial if you decide to continue (standard CPA consumer rights)

Data Protection & Privacy (POPIA Compliance)

How We Use Your Information

Primary Purpose: Custom app development for your trial and Webafrica fibre referral processing
Data Sharing: Your contact details shared with Webafrica for fibre service activation only (with your consent)
Security: HTTPS/TLS encryption, secure databases, access controls, and industry-standard protection measures
Data Retention: Stored only for necessary business periods; automatic deletion after trial if you cancel

Your POPIA Rights: Access your data, request corrections, object to processing, or request deletion anytime. Contact our Data Protection Officer at dpo@mtronika.co.za (response within 72 hours as per POPIA requirements).

Electronic Agreement Terms (ECTA Compliance)

By submitting the trial signup form above, you acknowledge and agree that:

Your electronic submission constitutes a legally binding agreement under the Electronic Communications and Transactions Act (ECTA)
You consent to receiving electronic communications (email confirmations, trial updates, decision requests)
You have read, understood, and agree to these trial terms and Mtronika's full Terms & Conditions
You consent to Mtronika sharing your contact details with Webafrica for fibre service activation (POPIA consent)
You understand that Mtronika is a referral partner, not a reseller, and that fibre services are provided by Webafrica
